La sentencia del 28 de Abril de 2009 absuelve de todos los cargos a los 9 imputados del Juicio por los hechos de la manifestaci&oacute;n en el Gayxample de hace cuatro a&ntilde;os. El apoyo y la colaboraci&oacute;n de todas las personas que habeis seguido esta causa ha sido muy importante y valiosa, gracias a todos de coraz&oacute;n!

   <title>27 de Abril: Juicio Queeruption 8 Karcelona</title>

Durante la primera semana de Junio del 2005 tuvo lugar en L'Hospitalet de Llobregat &ldquo;Queeruption 8 Karcelona&rdquo;, un encuentro autogestionado e internacional de queers radicales. Durante esas jornadas se realizaron diferentes actividades, tanto dentro como fuera de los espacios habilitados para ellas. Una de las muchas iniciativas se concret&oacute; en una manifestaci&oacute;n l&uacute;dico-festiva y reivindicativa por la zona gay comercial de Barcelona, el Gayxample, como cr&iacute;tica de los bares, clubs y comercios destinados al p&uacute;blico homosexual por jugar un papel importante en la creaci&oacute;n del estereotipo de &ldquo;lo gay&rdquo;, de la guettizaci&oacute;n y mercantilizaci&oacute;n de nuestras sexualidades y del capitalismo rosa. A la vez, quer&iacute;amos invitar a las personas a ocupar festivamente el espacio p&uacute;blico y sobretodo a&nbsp; visibilizar la existencia de otros espacios fuera de los circuitos comerciales de interrelaci&oacute;n, donde podemos escapar a la heteronormatividad y la homo-lesbo-transfobia.

Durante el transcurso de la colorida manifestaci&oacute;n se repartieron octavillas explicativas, se jalearon diferentes lemas, se hizo mucho ruido y algun*s decoraron las paredes con sus pensamientos. Pero tambi&eacute;n hubo momentos de mala comunicaci&oacute;n, lo que provoc&oacute; malentendidos entre algunos clientes de los establecimientos comerciales y participantes de la manifestaci&oacute;n. Como parte de nuestra lucha contra la lesbo-trans-homofobia nos hubiera gustado evitar las emociones negativas que surgieron para algunas personas.  
Tambi&eacute;n hubo momentos de confusion y tensi&oacute;n entre algun*s manifestantes y empresarios o encargados de alg&uacute;n establecimiento que acabaron con alguna maceta rota y da&ntilde;os en la recepci&oacute;n del hotel de lujo gay Axel. 
 
 
 
 
 Detenciones arbitrarias y torturas en comisaria: Denuncias archivadas 
 
 
 
 
Una vez disuelta la manifestaci&oacute;n, quedando parte de l*s&nbsp; manifestantes en Plaza Universidad, aparecieron unos hombres que sin identificarse como polic&iacute;as nacionales, empezaron a agredir y detener brutalmente a la gente que se encontraba all&iacute;. Las personas que observaron como agred&iacute;an y tiraban al suelo a sus conocid*s&nbsp; se acercaron con la intenci&oacute;n de parar dichas agresiones, siendo igualmente est*s detenid*s. En total fueron nueve detenciones totalmente arbitrarias. 
 
L*s detenid*s fueron humillad*s en todo momento. Una vez en comisar&iacute;a, l*s llev&aacute;ron a un cuarto de un* en un* donde l*s desnudaban y l*s insultaban con distintas frases hom&oacute;fobas como; &ldquo; Maric&oacute;n, te voy a meter la porra por el culo&rdquo;, &ldquo;Eres un mierda de t&iacute;o, no vales para nada marica&rdquo;, &ldquo;Eres m&aacute;s basta que una lija&rdquo;. Mientras l*s dem&aacute;s estaban en la habitaci&oacute;n de al lado esposad*s al banco o&iacute;an los gritos de l*s compa&ntilde;er*s que estaban en dicho cuarto con la polic&iacute;a.  
 
Se produjeron m&aacute;s agresiones f&iacute;sicas, como por ejemplo: &ldquo;&hellip;di&oacute; un golpe con la mano en la cabeza del primero con tal fuerza que rebot&oacute; en la cabeza de la segunda, y tras esto, di&oacute; una patada con la bota en el pecho del mismo detenido, lo que le provoc&oacute; un shock nervioso con temblores e insuficiencia respiratoria. Pedimos un m&eacute;dico pero los policias se rieron sin darle ni un vaso de agua&hellip;&rdquo; (extracto del testimonio de un* de l*s detenid*s)  
 
Algun*s de l*s detenid*s no eran ni catalano ni castellano parlantes y la polic&iacute;a les neg&oacute; el acceso a traductores que les facilitasen la comprensi&oacute;n de lo que estaba sucediendo. 
 
Dos d&iacute;as despu&eacute;s, tras pasar a disposici&oacute;n judicial, quedaron en libertad provisional a espera de juicio bajo los cargos de lesiones, des&oacute;rdenes p&uacute;blicos, da&ntilde;os y resistencia a la autoridad. A un* de l*s detenid*s se le pide dos a&ntilde;os y seis meses de c&aacute;rcel m&aacute;s 11.400 euros entre indemnizaciones y pena multa, y al resto un a&ntilde;o y seis meses de prisi&oacute;n y entre 5.700 y 11.000 euros. No existe ninguna prueba que avale la acci&oacute;n de estas personas bajo los cargos que se les imputan, ya que las detenciones se produjeron de manera arbitraria, lo que demuestra la detenci&oacute;n de una chica que s&oacute;lo pasaba por all&iacute;. 
 
Cinco de l*s nueve detenid*s presentaron denuncias contra la Polic&iacute;a Nacional por&nbsp; torturas, malos tratos y trans-lesbo-homofobia recibidos en comisar&iacute;a. Estas fueron archivadas dos veces por el juez, hasta que se envi&oacute;&nbsp; a la Audiencia Provincial, la cual orden&oacute; una investigaci&oacute;n de los hechos. A la citaci&oacute;n judicial donde deb&iacute;an declarar los polic&iacute;as denunciados no aparecieron los directamente imputados, y finalmente una vez m&aacute;s se archiv&oacute; la denuncia. Hecho que recoge y denuncia Amnist&iacute;a Internacional&nbsp; en su informe del a&ntilde;o 2007;  Espa&ntilde;a: Sal en la herida. La impunidad efectiva de agentes de polic&iacute;a en casos de tortura y otros malos tratos  (pags 50-52)  
 
Despu&eacute;s de quedar la polic&iacute;a una vez m&aacute;s impune de los delitos de malos tratos y tortura que cometieron, ahora mismo estamos esperando el juicio que se celabrar&aacute; el 27 de Abril, que en el peor de los casos conllevar&iacute;a el ingreso en prisi&oacute;n y un total de indemnizaciones y pena multa de 80.000 euros para l*s nueve detenid*s . 
 
Vista la gravedad de estos hechos,  EXIGIMOS la ABSOLUCI&Oacute;N de tod*s l*s detenid*s. 
 
 
 
 
Y denunciamos:  
-La impunidad con que el cuerpo nacional de polic&iacute;a act&uacute;a y miente. 
-Los malos tratos, torturas, agresiones y humillaciones homo-trans-lesb&oacute;fobas recibidas de dicho cuerpo policial por nuestr*s compa&ntilde;er*s.  
 
 Os convocamos a la concentraci&oacute;n delante de juzgados el 27 de abril.

   <title>April 27, 2009:  The trial of the Queeruption 8, Karcelona</title>

  Lesbo-homo-transphobic police &ndash; Complicit justice   
 
During the first week of June 2005, &ldquo;Queeruption 8, Karcelona&rdquo; took place near Barcelona. The event was a self-organized international gathering of radical queers. During the gathering different activities took place both inside and outside of the spaces that had been prepared for the event.&nbsp; One of the many initiatives took the form of a playful, festive, and revindicative demonstration through the commercial gay zone of Barcelona, the Gayxample, and was meant as a critique of the bars, clubs, and businesses which are geared towards the gay public and which play an important role in the creation of the stereotype of what it is to be gay, the ghettoizing and marketing of our sexualities, and pink capitalism. At the same time, the demonstration also had the goal of inviting people to festively &ldquo;occupy&rdquo; public space and above all to make visible the existence of other spaces which lie outside of the circuit of commercial exchange &ndash; spaces where we can escape from heteronormativity and homo-lesbo-transphobia. &nbsp;

During the course of the this colorful demonstration, explanatory pamphlets were handed out, different slogans were cheered, a lot of noise was made and some people even decorated the walls with their thoughts. But there were also moments of poor communication which caused misunderstandings between some of the clients of the commercial establishments and some of the participants in the demonstration.&nbsp; As part of our fight against lesbo-trans-homophobia, we would have liked to avoid the negative feelings which some people experienced. There were also moments of confusion and tension between some of the demonstrators and the business owners or managers of one of the establishments which ended with a broken flowerpot and damages in the reception lounge of the gay luxury hotel, the Axel. 
 
After the demo had ended, leaving some of the demonstrators in Plaza Universidad, men appeared who, without identifying themselves as agents of the national police, began to attack and brutally arrest the people that they encountered there. People who witnessed how their friends were attacked and thrown to the ground approached with the intention of stopping the attacks but were then also arrested. In the end nine completely arbitrary arrests took place. 
 
The detainees were continuously humiliated. Once at the police station, they were brought one by one to a room where they were forced to undress. The police insulted them, using various homophobic phrases such as, &ldquo;Faggot, I'm gonna stick my nightstick up your ass,&rdquo; &ldquo;You're worthless as a man. You don't count for shit, faggot,&rdquo; &ldquo;Girl, you're rougher than a piece of sandpaper.&rdquo; While this was going on, the rest of the detainees were handcuffed to a bench in the adjoining room where they could easily hear the screams of their peers who were with the police.  
 
Physical aggressions took place, for example, &ldquo;...[the policeman] hit one detainee in the head so hard with his fist that the person's head bounced against the head of another detainee and after that he kicked the same detainee in the chest, producing a nervous shock which included tremors and loss of breath. We asked for a doctor but the police laughed at us without even giving the injured detainee a glass of water...&rdquo; (extract from the testimony of one of the detainees). 
 
Some of the detainees were neither Spanish nor Catalan speakers and yet the police denied them access to translators who would have made it easier for them to understand what was happening. 
 
Two days later, after appearing before a judge, the detainees were granted provisional release awaiting trial. Their charges include bodily harm, public disorder, property damage, and resisting authority. The district attorney is asking for 2 &frac12; years of prison and 11,400 euros in fines for one detainee and 1 &frac12; years of prison and between 5,700 and 11,000 euros in fines for the others. There is no evidence which links the detainees to the actions of which they are accused, especially as the arrests were made completely arbitrarily, a fact which is demonstrated by the arrest of one woman who was only passing through Plaza Universidad.  
 
Five of the nine detainees made official accusations against the National Police for torture, mistreatment, and trans-lesbo-homophobia suffered at the police station. These accusations were filed away by a local judge two times in a row before being sent to a higher court, the Audiencia Provincial, which ordered an investigation into the events.&nbsp; But on the date when the accused officers were meant to testify before a judge, said officers did not appear in court and the accusations were once again filed away. This fact was cited and denounced by Amnesty International in their 2007 report entitled, Spain: Adding insult to injury: The effective impunity of police officers in cases of torture and other ill-treatment (pages 49-52).&nbsp; www.amnesty.org/en/library/info/EUR41/006/2007/en  
 
And now, after the police have emerged yet again unpunished for the abuse and torture which they commited, right at this very moment we are awaiting the trial of the nine detainees which will take place on April 27 and which, in the worst case scenario, will result in jail time and 80,000 euros worth of fines for these nine people.  
 
Given the gravity of these events, WE DEMAND: 
-The ABSOLUTION of all of the detainees. 
AND WE DENOUNCE: 
-The impunity with which the police act and lie 
-The abuse, torture, aggessions, and homo-trans-lesbphobic humiliations which our comrades received at the hands of the police. 
 
We encourage everyone to come to the concentration in front of the courthouse on April 27, 2009.

   <title>9 Personas En Espera De Juicio</title>

&nbsp;Este es el texto explicativo que repartiamos en las Kafetas Desviadas que fuimos realizando. En&nbsp;&eacute;l se explica lo de la manifestaci&oacute;n, lo de la gente detenida y el trato que recibieron de&nbsp;la polic&iacute;a, como el juez se pas&oacute; por el forro las denuncias de torturas y malos tratos recibidos&nbsp;por  nuestr@s   compa&ntilde;er@s  y como&nbsp;se estaba a la espera&nbsp;del juicio&nbsp;contra estas 9 personas&nbsp;cuya citaci&oacute;n lleg&oacute; a&nbsp;principios de septiembre 08,&nbsp;despu&eacute;s de&nbsp;las vacaciones, cuando el abogado llega a su despacho y v&eacute; que SORPREESAAA!!!!!! en tres semanas es el juicio para  l@s  9 de queeruption... Tres semanas para preparar el juicio y cuatro personas implicadas que no viven en el estado espa&ntilde;ol... Finalmente conseguimos atrasar el juicio.
